Personal Injury on Association Property

When an injury occurs on association property, the first course of action is always to ensure the health and safety of the injured person by calling 911 or taking other, similar actions aimed at helping the injured person.

Boards should have a set of established procedures to preserve evidence from the scene in anticipation of any possible litigation. 

Be certain to immediately take pictures and write up an incident report.  Gather the names and contact information of witnesses, if any.  Be certain to immediately contact the association’s insurance company and notify them of the accident.  Thereafter, should the board receive any type of legal demand for damages caused by the injury, be certain to immediately contact both legal counsel and the association’s insurance carrier.
